Shoulder impingement from a vaccine injection is a distinct, diagnosable injury with its own symptom pattern and eligibility criteria under the National Vaccine Injury Compensation Program (VICP). When an injection is placed too high or too deep in the deltoid muscle, inflammation can narrow the subacromial space, the gap between the top of the arm bone and the shoulder’s bony arch. Tendons passing through that narrowed space get pinched during everyday arm movement, producing sharp or aching pain at the front or side of the shoulder that worsens when lifting the arm or reaching overhead, along with a measurable loss of range of motion.

Table Injury Criteria for Shoulder Impingement

The VICP’s Vaccine Injury Table lists SIRVA as a covered Table injury, meaning claimants who meet specific criteria may receive a legal presumption that the vaccine caused their injury. For shoulder impingement to qualify, several conditions generally must be met: symptoms must begin within 48 hours of vaccination, the pain and reduced range of motion must be limited to the shoulder where the vaccine was administered, the claimant must have no prior history of pain, inflammation, or dysfunction in that shoulder, and no other condition can explain the symptoms. The Vaccine Act separately requires that the injury last more than six months, or involve inpatient hospitalization and surgery, before compensation can be awarded. When these criteria are satisfied, the burden may shift away from the claimant on causation.

Claimants who don’t meet every Table criterion may still pursue an off-Table claim by presenting medical and scientific evidence of causation. We evaluate both pathways when we review a new case.

Which Vaccines Are Most Often Linked to Shoulder Impingement

Shoulder impingement claims most commonly involve vaccines administered in the upper arm, including the influenza (flu) shot, Tdap (tetanus, diphtheria, and pertussis) vaccines, and pneumococcal vaccines. The injury arises from how and where the injection was placed, not from the vaccine’s formulation. An injection given too high on the deltoid or at the wrong angle can reach the subacromial bursa or rotator cuff tendons, triggering an inflammatory response. Any covered vaccine administered in the shoulder can produce this result when injection technique is at fault.

Filing Deadline for a Shoulder Impingement Claim

Under 42 U.S.C. § 300aa-16(a)(2), a non-fatal VICP claim must generally be filed within three years of the first symptom of the vaccine-related injury. For shoulder impingement, that clock starts from the first day you noticed shoulder pain or reduced mobility following vaccination, not from the date a physician first documented “SIRVA” or “impingement syndrome” in your chart. California residents who delay seeking legal guidance may lose access to the program, regardless of how strong the underlying claim might be.

  • What is a Vaccine Injury Lawsuit?

    There are two types of lawsuits possible for a vaccine injury. 

    1. The most common is a Petition (complaint) filed before the United States Court of Federal Claims (”USCFC”) in Washington D.C. These cases are always defended by the Department of Justice (DOJ) attorneys in the Vaccine Division. The DOJ employs approximately 35 attorneys. The Vaccine Division of the USCFC has 8 full-time Special Masters (Judges) who hear these cases. To file a federal case under the Vaccine Injury Program, it is wise to retain an experienced vaccine law firm to assist you as many cases need to be supported by expert medical testimony in order to succeed. Additionally, experienced attorneys know the potential value of a case when weighing the risk and likely compensation during settlement negotiations. 

    2. The second type of vaccine lawsuit is under State Law for products liability, or personal injury. It involves paying the cost for experts and depositions and varying legal standards. It may be more difficult to prove with respect to those vaccines not covered by the Vaccine Injury Compensation Act. For now, the traditional court system may be the only legal recourse available for non-covered vaccines. The exception to this is for Covid-19 cases. Sadly, Covid-19 cases are covered by the very restrictive Countermeasures Injury Compensation Program (CICP) which is nonjudicial. Our law firm does not represent individuals in any administrative nonjudicial program.
